Each User is responsible for what occurs on their user’s account and must report any unauthorised use of their user’s account to us.
3. Jurisdiction. The Site is controlled and operated from our offices in United Kingdom. BFC makes no representation that the contents of the Site or the Services are appropriate, or available for use in, other locations. By agreeing to these Terms, you agree that your use of this Site shall be deemed to have occurred solely in the United Kingdom. By using the Site from other locations, you do so on your own initiative and you are responsible for compliance with local laws. You further agree and acknowledge that these Terms and any dispute in connection with your use of the Site or the Services will be governed by the laws of England and Wales, in the United Kingdom. In the event of any dispute relating to the Site, the Services or the Terms, you expressly consent to the exclusive forum, jurisdiction, and venue of courts of England and Wales, in the United Kingdom.
4. Users. The terms "You", "Your", "User", or "Users" refer to anyone accessing our Services or Site for any reason. BFC provides a venue to introduce Users who wish to provide professional services ("Providers") and Users who seek such professional services ("Buyers") (respectively or jointly as the "Parties"). The Site enables Users to identify each other and work together online to complete, invoice and pay for projects.
The only parties to a project are the Provider and the Buyer. Upon the Buyer awarding a project to a Provider and the Provider’s acceptance of a project on the Site, the Buyer agrees to purchase, and the Provider agrees to deliver the Provider Services in accordance with this agreement. You agree not to enter into any contractual provisions in conflict with the User Agreement. Any provision of a member contract in conflict with the User Agreement is void.
When you enter into a transaction you create a legally binding contract with another User, unless the transaction is prohibited by law or by this agreement.
You are responsible for ensuring that you comply with your obligations to other Users. If you do not, you may become liable to that User(s). You must ensure that you are aware of any domestic laws (including common law) international laws, statutes, ordinances and regulations relevant to you as a Buyer or Provider, or in any other uses you make of the Site.
If another user breaches any obligation, you are solely responsible for enforcing any rights that you may have. For the avoidance of doubt, BFC has no responsibility for enforcing any User rights.
BFC does not offer any form of insurance or other Buyer or Provider protection which will assist you, because our Site merely provides the online venue for Users to offer, sell, and buy professional services and we are not otherwise involved in the transactions and interactions between Buyers and Providers. However, some forms of payment permitted on the Site, such as PayPal or Przelewy24, may offer limited buyer or Provider protection or chargeback services and you should familiarise yourself with these before proceeding with a transaction of any kind through the Site.
Because user identification on the Internet is difficult, we cannot and does not confirm each User's purported identity.
5. Services offered by BFC. Services are for use only under a non-exclusive, non-transferable, and non-assignable license under these terms and conditions of use. You do not have the right to copy, sell, or otherwise exploit for any commercial purpose the Services or content (in whole or in part), access to this service or use of this service.
Our Site merely acts as an online venue to allow Users to offer and buy professional services. You acknowledge and agree that BFC is not involved in the actual transaction between the Providers and Buyers. As a result, BFC has no control over the quality or legality of the professional services provided by Users on our Site, or the ability of Providers to provide the services or the Buyers to pay for the services. We do not guarantee that a User will actually complete a transaction or act lawfully in using the Site.
Some of the content provided at the Site may relate to various subjects such as information pertaining to legal matters, financial matters, and other matters for which the content of is provided in an advisory nature. This information is provided solely for informational and general non-advisory purposes. If desired, Users should use their own efforts to confirm such information with a professional(s) in the pertinent field(s). All of the information that BFC provides should not be considered professional, medical, legal, technical, or any other discipline-specific advice.
The Site is a dynamic time-sensitive web site. As such, the information on the Site will be changed frequently. BFC does not have the resources to nor does it undertake any obligation to, control, research, verify, validate, or approve the content that is received or viewed on its web site. BFC expect that the User will undertake necessary activities and practices and will use caution and common sense when using User's Account.
6. Fees and Payments. Refer to Fees section on the website for details of payments and commissions. All payments are final and non-refundable. Please contact the Priovider instead of us if you face any problems after the project has been completed and you make a payment through our system.
BFC offers non-compulsory feature, which allows controlled payments to be made with respect to a project to a Provider. At your request, BFC will accept an advance payment from a Buyer for a project. We will hold such funds ("Escrow Payments") until the Buyer and the Provider agree that the funds should be released to the Provider.
In the event that the Buyer has not provided any instruction to BFC with respect to an Escrow Payment within 1 year after the day that the Escrow Payment was made, and has not logged in during that time period, such Escrow Payment will be refunded to the User account of the person who initially paid it.
Any disputes regarding arrangements between Providers and Buyers remain solely between Buyers and Providers. We are not involved in any transactions between you and any other users of BFC. You acknowledge and agree that BFC will not be a party to any such dispute or be obligated to take any action or refrain from taking any action toward resolving any such dispute. If you have a dispute with any other users of the Site, you hereby release BFC from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, related to such a dispute.
7. Bidding. Service Providers can only place bids that equal the total amount of money they are requesting for the project. You cannot post an hourly bid or any other abnormal type of bid. This also applies to Buyers. Service Buyers cannot create projects that directly or indirectly require Service Providers to place hourly or other abnormal bids.
8. Taxes. You are responsible for paying any taxes, including any goods and services or value added taxes, which may be applicable depending on the jurisdiction of the services provided by BFC.
9. Advertising. Users are prohibited from advertising a website on the Site. Any URL posted in a bid, project description, or the message board, must relate to a project on the Site.
10. Limited Licence to Use Software. Where users of the Site are permitted to download software in connection with the Services, such software, including any files or images incorporated in or generated by the software and any data accompanying the software (collectively, the "Software") is merely licensed to you by BFC or others. This licence is personal, non-transferable and non-assignable. Title to the Software is not being transferred to you. Although you may own the medium on which the Software is recorded, stored, displayed or used, BFC, or others, retains copyright in and title to the Software and all other intellectual property rights therein. You shall not reproduce, redistribute, sell, decompile, reverse-engineer or disassemble the Software.
11. Disclaimer. Unless otherwise provided, the contents of the site are provided without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, BFC, its affiliates and licensors disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose, any information contained in the Site or on any site to which it is linked. BFC, its affiliates and licensors do not warrant the functions, information or links contained on the site or that its contents will meet your requirements, that the Site, or its contents, are fit for any particular purpose or that the operations of the Site or its contents will be uninterrupted or error-free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses, worms or other harmful components. BFC, its affiliates and licensors do not warrant or make any representations regarding the use or the results of the use of the materials and/or services provided by or through the Site in terms of their correctness, accuracy, reliability, security or otherwise. You (and not BFC) assume the entire cost of any necessary servicing, repair or correction that may result from your use of the Site.

You may terminate this agreement at any time by contacting BFC customer support by e-mail at contact@wolnystrzelec.com, in which case, termination is effective at the end of the business day following the day on which your termination notice is actually received by BFC. These Terms will terminate immediately without notice from BFC if, in BFC’s sole discretion, acting reasonably, you fail to comply with these Terms.

BFC reserves the right to change this Privacy Policy at its sole discretion. Changes will be effective when they have been posted on the Site.
